QWAK,Befor you DIE try to remember to CANCEL your CREDIT CARDS or the BANK will come after YOU ware ever you go! :rant:
A lady died this past January, and Citibank billed her for February and March for their annual service charges on her credit card, and then added late fees and interest on the monthly charge.

The balance had been $0.00, now is somewhere around $60.00.

A family member placed a call to Citibank:

Family Member: "I am calling to tell you that she died in January."

Citibank: "The account was never closed and the late fees and charges still apply."

Family Member: "Maybe, you should turn it over to collections."

Citibank: "Since it is two months past due, it already has been."

Family Member: So, what will they do when they find out she is dead?"

Citibank: "Either report her account to the frauds division or report her to the credit bureau, maybe both!"

Family Member: "Do you think God will be mad at her?"

Citibank: "Excuse me?"

Family Member: "Did you just get what I was telling you . . .the part about her being dead?"

Citibank: "Sir, you'll have to speak to my supervisor."

Supervisor gets on the phone:

Family Member: "I'm calling to tell you, she died in January."

Citibank: "The account was never closed and the late fees and charges still apply."

Family Member: "You mean you want to collect from her estate?"

Citibank: (Stammer) "Are you her lawyer?"

Family Member" No, I'm her great nephew." (Lawyer info given)

Citibank: "Could you fax us a certificate of death?"

Family Member: "Sure." (Fax number is given)

After they get the fax:

Citibank: "Our system just isn't set-up for death. I don't know what more I can do to help."

Family Member: "Well, if you figure it out, great! If not, you could just keep billing her. I don't think she will care."

Citibank: "Well, the late fees and charges do still apply."

Family Member: "Would you like her new billing address?"

Citibank: "That might help."

Family Member: "City Memorial Cemetery, Row 129, Plot Number 69."

Citibank: "Sir, that's a cemetery!"

Family Member: "What do you do with dead people on your planet?"

So, forgive my ignorance, but how does it work? After you die, can the credit card companies collect from your estate? I assume that they can.

Never mind: I found the answer. (Yes, they can collect from the estate.)

Try this one...it happened to me.

AT&T: Hello,Customer service may I help you ?

Me: Yes,you sent me a phone bill for $1380.00 worth of long distance charges for telephone number XXX-XXXX which is an old number I had 15 years ago...it was disconnected in 1985 and I am not the customer who owns that number or made the charges.

AT&T:Sir,I am not allowed to discuss this matter with you until your bill is paid in full.

Me: Excuse me lady, are you deaf or maybe mentally retarded by some chance ?

AT&T: No Sir,we accept Master Card,Visa,or you can pay by bank draft and have your service restored and your credit record expunged for non payment as soon as you clear up these charges.How will you be paying today Sir ?

Me: You're on drugs...right ?

AT&T: No Sir,now how will you be paying ?

Me: Put your supervisor on the phone.We're not on the same page lady.

AT&T: Supervisor speaking...what seems to be the problem Sir ?

Me: I repeat the story very slowly.

AT&T: Well Sir...our records show you made the long distance charges on number XXX-XXXX and I'm afraid you're responsible for them.Now how will you be paying ?

Me: I won't....not now...not ever...hold your breath until hell freezes over.

AT&T: I'm sorry Sir...I will have to turn this matter over to our collection division and your credit will be ruined since this is such a huge amount of long distance charges you currently have outstanding.

Me: Let me ask you a question: Do you smoke dope or have a raging cocaine habit that prevents your comprehension of the English language ?

AT&T: No sir.I am a college graduate and I understand English quite well.

Me: Well then...understand this...I will repeat it quite slowly so we understand each other...stop me if I confuse you as I speak.

I am turning this matter over to my attorney and billing AT&T $1380.00 plus attorney fees for my time and trouble explaining to morons like you why I will not pay a stinking bill for long distance charges on a telephone number I am not the owner of as soon as I hang up this phone...
If you don't pay the invoice I will turn it over to an outside collection agency and my attorney will demand punitive damages for mental stress due to gross incompetence on your part...May I please have your name and employee ID for my attorney so he can process the complaint this afternoon ?

AT&T: Long silence....

AT&T: Oh,I'm sorry Sir...our computer records are incorrect.You are not the party that owes AT&T...someone in accounts receivable has entered your name in error....thank you for calling AT&T....BANG...slams the phone or something down and the bitch hangs up on me.

Me: :>) Morons !!!

Anyway...I never got another bill...so I guess it ended well.

BTW: I would have sent the $1380.00 bill...bet on it.
I also would have turned it over to my attorney and screamed harassment and excruciating mental stress problems.

I would almost bet they would have settled out of court too :>)

QWAK, Maddie,They may not be able to get BLOOD out of a TURNUP but they WILL give it a TRY!:sarc: At least it aint like the "GOOD OLD DAYS" when they would throw your family in DEBTORS PRISON ------- YET! And not if the estate simply doesn't pay them.

Had something similar happen on my mom's estate. I was the executor, and I simply paid out what little there was to the heirs, and threw stuff like that in the trash.

What are they gonna do.....put me in jail ? Screw 'em.

It's actually MORE fun to just ignore them....causes them to use up way more resources in a fight they don't have a chance of winning.

That is the beauty of a Trust versus a probated estate, under a probated estate a certain amount of time has to pass after legal announcements are published before any assets can be distributed, anybody can make a claim and with the funds under court control there is a big incentive to pursue claims. With a Trust the assets can be distributed(privately) as soon as the death certificate is issued and any claims are made against an empty estate.

I think its mostly just financial blackmail had a collection agency call and send
bills repeatedly and kept upping the charges for towing charges on a car we no longer owned.last time I talked to them they threatened to report us to a credit reporting agency and ruin our credit.I told them go ahead I have all the credit im ever going to want I told them very bluntly we dont owe it to you you aint getting it and told them if they ever feel the need ill bee happy
to tell them to f off never heard from them again and it has never appeared
on our credit report.what is realy sad is we know that the towing company
knew it wasn,t our vehical the towing/storage charge was let go way above the value
of the vehical before we were even notified.we figure that they knew they couldnt get any money out of the owner so they thought they would try
us.

Send a certified letter telling them to contact you only by letter. They must abide by it and cannot call you thereafter. Even when you're in the right, it's a good idea to do this. Collection agencies often don't limit their calls to the debtor. They'll call the debtor's employer and neighbors under the pretense of trying to reach the debtor and will, of course, spill their whole story to whoever answers the phone, hoping to humiliate the debtor into paying up.

We had next-door neighbors once who got into trouble, and the collection agency called us "looking for" our neighbors (we barely knew them!) several times a day for months. A couple of years ago I had a coworker who got in trouble, and the collection agency kept calling our employer and spilling the story to anyone who answered the phone. There wasn't an employee in the building who didn't know that the woman was in trouble with creditors over her car payments.
